With the existing condo legislation as well as updates that are being proposed, there is no protection against this situation, so be careful. The problem arises in complexes that have mixes of different types of condominium structures. For example if there is a mix of apartments and townhomes, there can be only one condominium corporation designated for the legal plan of the complex. This causes inherent problems with budgeting and paying for attributed costs of the varying units. For example; It is usually the case that apartment style condominiums would have their heat included in their condominium fees, whereas a townhouse style would not. There are certain complexes in Calgary where this is in fact the situation and the townhouse owners are paying a share of the heating as well as common area costs for the apartment owners. In addition to heating, another considerable financial burden that the townhome owners may be forced to pay is that of elevator maintenance, which can be considerable. And, the list goes on.... |
